The Demise of the 28-Article Peace Initiative for Ukraine: Why Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency triggered by the introduction of a new comprehensive peace framework for resolving the conflict appeared – momentarily – to have been stabilised. A senior US official spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, the Kremlin made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Negotiation and Warfare

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, political struggles are waged: hopeful statements are delivered from multiple capitals. Immense energy is allocated on restraining certain initiatives. By night, the Kremlin clearly shows the world that, for them, war remains the primary tool for achieving "resolution".

Nocturnal Warfare

As military strikes developed into the early hours of Tuesday, the present situation of Ukraine's vulnerability was revealed. Ukraine is able to track rocket firings from across the border, a ability enabled by current data. From witness perspectives, defense planes that had been scrambled to intercept incoming cruise missiles roared overhead – modern combat jets supplied to Ukraine by European allies.

Soon thereafter, Kyiv's air-defence systems activated: defensive missiles targeted at a hostile projectile. This was a modern interception technology at work, most likely provided by allied countries. Every deployment jolts you unexpectedly, rattling buildings. The instant of fear quickly gives way to grim resignation: perhaps the incoming missile won't strike its target this time, protecting urban areas from ruin and further power outages.

Ongoing Risks

Soon after, a automatic firearm opened up on a drone in the vicinity, part of a mobile-fire group – probably Western-made equipment. Regrettably, the shots failed to hit the enemy aircraft – it continued its flight toward its destination.

Intermittently, this carried on until dawn. Kyiv awoke to the daybreak reports: seven people killed, devastation and infrastructure problems in multiple buildings as a result of the evening attack. As customarily, everyone still maintained normal activities – living the war. But those entire period demonstrated Ukraine's essential dependence on international aid – a dependence that regional partners are evidently unprepared to fill in the immediate future.

Unsuccessful Negotiations

The comprehensive proposal from Washington sparked intense emotion, controversy and deep concern – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have experienced comparable situations, after prior negotiation attempts and multilateral gatherings.

Every new approach from US leadership unfolds according to the consistent cycle: a political offensive against Ukraine, which Kyiv, with allied governments, effectively counters. They contain the crisis but never actually secure success. This cycle will, certainly, endure.

Strategic Calculations

It is convenient to criticize certain parties of persistently promoting Russian terms. But that does not seem to be the whole story. US administration works based on a assumption familiar among seasoned negotiators: you cannot achieve through diplomacy what you have lost on the battlefield. The American government assumes that it is unfeasible to pressure the Kremlin to surrender the areas that it currently occupies in Ukraine's occupied territories.

The issue is that while acknowledging this situation, Washington does nothing to deter Moscow, through diplomacy or military means, from assuming that the current condition will not change more in its benefit in the months ahead.

Opposing Positions

Therefore, Russian leadership is convinced that duration works to their advantage – that Ukraine and its allies are nearing depletion. Their incentive to accept conditions that does not give them the largest achievable advantage is close to zero. There may be many attempts to stop fighting, but they will carry on as long as Russia's leadership remains highly assured in the outcome.

On the contrary, Kyiv believes that Ukraine can still hold out, slowly losing civilians and areas but preventing a total frontline collapse until circumstances change in its favour.

Existing Situation

Realistically, there are no genuine requirements for a ceasefire. Now, individual motivations are coming into play: personal goals to broker a ceasefire and obtain worldwide acknowledgment, and Kyiv's dual difficulties – on one hand, not to estrange crucial supporters, and on the other, to unite the population around the flag against any initiative Kyiv finds unacceptable, so that their attention does not shift toward domestic problems. And although their task will now be much harder after latest incidents, it remains very improbable that this will alter their fundamental strategy.

These two forces are guiding negotiations.

Summary and Prospects

It took a just a single week to terminate the suggested clauses of the most recent proposal. Forceful and unpredictable management of the matter by US administration, resistance by Ukraine and the remaining European nations, along with soothing efforts of diplomats, and finally, latest revelations, all served their function.

While new initiatives based on old ideas are forthcoming, Kyiv, London and other allied nations should draw one fundamental conclusion: Ukraine and Europe will only be able to counter diplomatic offensives from Washington that are founded on Moscow's terms and demonstrate specific hesitation to modify developments, if they maintain solidarity and improve their protective measures at a considerably quicker tempo. If they do, neither political nor armed coercion will be able to break them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the foreseeable future, largely rely on ongoing international assistance.
